Before you list

Documentation that speeds everything up

None of this is unusual to ask for — but having it ready before the first viewing, rather than assembling it after an offer comes in, is what actually shortens a transaction.

What changes the tax math

Selling

Property held more than 24 months qualifies as a long-term capital gain, taxed at a flat 12.5% (without indexation) for property bought on or after 23 July 2024. Property bought before that date gets a choice between 12.5% without indexation or 20% with indexation, whichever costs less — but that choice applies to resident individuals and HUFs only. Property held 24 months or less is a short-term gain, taxed at your normal income-tax slab rate. Buyers deduct 1% TDS at source under Section 194-IA on sales above ₹50 lakh for resident sellers; NRI sellers face a materially higher upfront TDS deduction (commonly cited around 20% on long-term gains), though a lower-deduction certificate from the Income Tax Department can reduce that where the actual tax liability is lower.

Leasing

A lease agreement for a term of 12 months or more requires compulsory registration and stamp duty under the Registration Act — which is exactly why most residential leases in India are written for 11 months. On commercial rent specifically, landlords with rental income above ₹20 lakh a year must register for GST and charge 18% on the rent; tenants deduct 10% TDS on rent above ₹2.4 lakh a year under Section 194-I.
